Common questions

Can I still sue the driver who hit me?

For most crashes on or after May 1, 2021, no. British Columbia moved to a no fault system, so instead of suing you claim benefits through ICBC's Enhanced Care. There are narrow exceptions, such as when the at fault driver is convicted of a serious criminal offence like impaired driving. We can look at your accident and tell you which rules apply to you.

What can I actually claim now?

Enhanced Care provides benefits to support your recovery rather than a lawsuit settlement. These can include medical and rehabilitation treatment, income replacement if you cannot work, care and caregiver support, and added benefits for serious or permanent injuries. We help you understand the full range you may be entitled to and make sure you receive it.

Do I really need a lawyer if it is no fault?

No fault does not mean automatic. ICBC still decides what treatment and benefits you get, and those decisions can be reduced, delayed, or denied. Having someone who knows the system on your side helps you avoid missteps and push back when something is not right. How long do I have to act?

Sooner is always better. Many claims carry a strict two year limitation period, and this can apply even to claims involving children, which often surprises parents. What should I do in the first week after an injury?

See a doctor early and report every symptom, even ones that seem small. Report a crash to ICBC, keep photos, receipts, and notes while details are fresh, and avoid signing anything you do not understand. Then get advice. A free case evaluation early often prevents problems that are hard to fix later.

I was hurt in a hit and run. Am I still covered?

Generally, yes. Enhanced Care benefits do not depend on identifying the other driver, so your treatment, income replacement, and care support can still flow. Report the crash to ICBC and to police as soon as you can, and note anything you remember about the vehicle. We can help from there.

I was injured as a passenger. Can I claim?

Yes. Passengers injured in a BC crash are covered by Enhanced Care benefits regardless of who was driving or who caused the crash, even if the driver was a family member or friend. Claiming benefits does not mean blaming anyone. It simply means getting the recovery support the system provides.

What if I was partly at fault for the accident?

For most BC crashes, fault no longer decides your benefits. Enhanced Care provides treatment, income replacement, and care support regardless of who caused the crash, so being partly responsible generally does not reduce your recovery benefits. If you are worried about your specific situation, ask us. The answer is usually reassuring.
